TERMS OF SERVICE
1. Scope and provider
These Terms of Service govern all orders placed through amarevella.com between you and:

We sell exclusively to consumers. A consumer is any natural person who enters into a transaction for purposes that are predominantly outside their trade, business or profession. We do not sell to resellers or for commercial resale. Orders that appear to be placed for resale may be cancelled.
You must be at least 18 years old, or have the consent of a legal guardian, to place an order.
Deviating terms and conditions of the customer do not apply unless we have agreed to them in writing.
2. Language and storage of the contract
The contract is concluded in English. We store the contract data and send you the order details by email. You can also view past orders in your customer account, if you have created one. These Terms of Service can be downloaded or printed from this page at any time.
3. How a contract is formed
The presentation of products in our online store does not constitute a binding offer. It is an invitation for you to place an order.
By clicking the final order button in the checkout, you submit a binding offer to purchase the items in your cart. Before submitting, you can review your order and correct entries using your browser and the checkout's editing functions.
We will confirm receipt of your order by email immediately. This confirmation of receipt does not yet constitute acceptance of your offer.
The contract is concluded when we send you a separate shipping confirmation, or when we dispatch the goods — whichever happens first. If we are unable to accept your order, for example because an item is unavailable, we will inform you without undue delay and refund any payment already made in full.
4. Prices
All prices are stated in euros and include German statutory VAT at 19 %.
Shipping costs are shown separately before you complete your order and are listed on our Shipping page. Standard shipping within Germany and the European Union is free of charge.
The price stated at the time of your order applies. We reserve the right to change prices for future orders at any time.
5. Payment
The following payment methods are available:

- PayPal
- Klarna
- Shop Pay
- Apple Pay
- Google Pay
Payment is due immediately upon conclusion of the contract. Card payments are captured when the order is placed. Where you pay through PayPal, Klarna, Shop Pay, Apple Pay or Google Pay, the terms and conditions of the respective provider apply in addition to these terms.
Klarna offers its own payment options, which may include deferred payment or instalments. These are provided by Klarna Bank AB (publ) under a separate agreement between you and Klarna. Klarna may carry out a credit assessment. Details are shown in the checkout before you select Klarna.
If you are in default of payment, we are entitled to charge default interest at the statutory rate.
6. Delivery
We ship to the destinations listed on our Shipping page. Delivery is made to the address you provide at checkout. We do not deliver to packing stations unless the carrier permits it.
Orders are processed within 1–2 business days. Estimated delivery times per destination are listed on the Shipping page. These are estimates and not guaranteed delivery dates, unless we have expressly agreed a fixed date with you in writing.
If an item becomes unavailable after your order, we will inform you without undue delay and refund any payment already made.
7. Retention of title
The goods remain our property until payment has been received in full.
8. Right of withdrawal
If you are a consumer, you have a statutory right to withdraw from this contract within 14 days without giving any reason. The full withdrawal instructions and the model withdrawal form are set out on our Right of Withdrawal page, which forms part of these Terms of Service.
9. Voluntary return policy
In addition to your statutory right of withdrawal, we do not offer an extended voluntary return period. Returns are handled as described on our Returns page. Your statutory rights remain unaffected by anything stated there.
10. Statutory warranty
The statutory warranty rights under German law apply to all goods we supply. If an item is defective, you are entitled to repair or replacement, and, under the statutory conditions, to a price reduction or to withdraw from the contract.
The limitation period for warranty claims is two years from delivery of the goods.
Please report any defect to info@amarevella.com with your order number and, where possible, photographs. We will arrange the return at our cost in these cases.
11. Liability
We are liable without limitation for damages arising from injury to life, body or health, for damages caused intentionally or by gross negligence, under the German Product Liability Act, and to the extent we have given a guarantee.
In the case of slight negligence, we are liable only for the breach of a material contractual obligation — an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely. In such cases our liability is limited to the foreseeable damage typical for this type of contract.
Any further liability is excluded.
12. Use of the website
You may not use this website for any unlawful purpose, to transmit malicious code, to interfere with its security features, or to collect data from it by automated means without our consent. We may terminate your access if you do.
All content on this website — including text, photography, graphics, logos and the Amare Vella name — is our property or licensed to us and is protected by copyright and trademark law. You may not reproduce or commercially use it without our written consent.
13. Accuracy of information
We take care to describe our products accurately. Colours may appear differently depending on your screen. Where information on this site contains obvious errors, typographical mistakes or omissions, we may correct them and, if an order was affected, cancel that order and refund you in full.
We are not obliged to update information on this site except where required by law.
14. User accounts
If you create a customer account, you are responsible for keeping your login details confidential and for all activity under your account. Please inform us immediately if you suspect unauthorised use.
15. Third-party services
Our store is hosted on Shopify. Certain functions — payment processing, product reviews, virtual try-on, size recommendation, email communication — are provided by third parties. Their terms and privacy policies apply to those services in addition to ours. Details are set out in our Privacy Policy.
16. Indemnification
You agree to indemnify us against third-party claims arising from your breach of these Terms of Service or your unlawful use of this website.
17. Severability
Should any provision of these Terms of Service be or become invalid, the validity of the remaining provisions remains unaffected.
18. Changes to these terms
We may amend these Terms of Service at any time with effect for future orders. The version in force at the time of your order applies to that order.
19. Governing law and jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
If you are a consumer resident in the European Union, this choice of law does not deprive you of the protection of mandatory consumer protection provisions of the law of your country of habitual residence.
